9.NADear Sir, On perusal of your application still a lot of deficiencies and PP is unable to submit the details: (i) CCR closure report has not been submitted by the PP which was earlier sought. This is not good practice on behalf of the PP/Consultant. (ii) This is the violation case and PP has not submitted the Revised EIA/EMP Report alongwith Copy of Remediation Plan and details of Penalty as per the provisions of the SOP dated 07.07.2021. In this regard, the Ministry has already communicated to PP; However PP has not submitted the details of violation and tried to hide the information. (iii) Thoush it is a violation case and PP has submitted its application under SOP dated 07.07.2021. (iv) Details of credible action as per SOP dated 07.07.2021 needs to be uploaded. PP immediately needs to stop the operation of the violated part of the implementation. (v) In view of the above violation case, PP needs to submit the Revised EIA/EMP Report as per SOP dated 07.07.2021 immediately for further appraisal by the EAC. 16 Mar 2023

1.NADear Sir, It may be mentioned that in the meantime in WP (Civil) No. 1394/2023 in Vanshakti Vs UoI, Hon'ble Supreme Court vide its order dated 02.01.2024 has inter-alia ordered that "Until further orders, there shall be stay of operation of the Office Memoranda dated 7th July 2021 and 28th January 2022 issued by the Ministry of Environment, Forest and Climate Change." In pursuance to the same, the instant proposal may be kept in abeyance till further orders, since the instant proposal was submitted under violation category as per the provisions contained in the MoEF&CC Standard Operating Procedure (SOP) dated 07.07.2021. It may be mentioned that the document submitted by PP/SPCB has been examined by the PD in the Ministry and it was observed that the SPCB has filed the court case under the Water Prevention and Control of Pollution Act 1974, not as per E (P) Act, 1986. The PP has to submit the documents/credible action taken/court case filed against the PP under the provisions of the Environment (Protection) Act, 1986 as per the provisions of Ministry’s OM dated 07.07.2021 for Violation. In view of the above, the undersigned has been directed to request you kindly submit the information regarding the credible action taken/court case files against M/sShri Bajrang Power & Ispat Limited and others for the offence committed u/s 19 of Environment (Protection) Act, 1986. 29 Jul 2023
