Ministry has also streamlined the process of handling Category B proposals at SEIAA/SEAC by removing back and forth movement of project proposals between SEIAA and SEAC. Therefore, henceforth, all fresh proposals irrespective of its type will be submitted to Member Secretary(MS), SEAC for initial scrutiny and further consideration by the Expert committee (SEAC) to make categorical recommendations to SEIAA concerned on the PARIVESH Portal itself. Further, in pursuance to the Ministry’s OM dated 06.05.2022, the new version of PARIVESH
(PARIVESH 2.0) has now enabled the MS, SEAC to issue Standard ToR in accordance with the procedure outlined in the mentioned OM.

Further, the SPCBs/PCCs shall initiate legal action against the project proponent under the relevant provisions of Environment (Protection) Act, 1986 for the projects not complying with the aforesaid SoP/environmental safeguards, as may be applicable.

Ministry deems it necessary to clarify the process for handling such proposals. For the scenarios mentioned at sub para (i) to (v) of para 2 above, the following procedures shall be followed:
The scenario mentioned at sub para (vi) of para 2 above, based on the request from the Member Secretary of SEIAA/State Government, a window period of 15 days shall be provided to the Member Secretary SEIAA, extendable by a further period of 15 days, to only upload the minutes/letters for the proposals which were duly approved by SEIAA before it became non-functional.
Further, in case of only SEIAA becoming non-functional / discontinued due to various reasons, the proposals pending with SEAC for (re)consideration up to the day of such discontinuation shall be (re)considered by the respective SEAC and forwarded to the Ministry along with recommendation as per the procedure prescribed at Para 3 above.

Based on the recommendations of the sectoral EAC, it is hereby clarified that Standalone plants producing Green Hydrogen/Green Ammonia by way of electrolysis of water using Renewable Energy, shall not require prior EC under the provisions of EIA
Notification 2006. However, the requisite consents under the provisions of the Air Act, 1981 and Water Act, 1974 shall be obtained, along with other statutory permissions/clearances as applicable. In case of setting up of such Green Hydrogen/Green Ammonia plants within the same premise of an existing unit
which other-wise require prior EC, the component of such Green
Hydrogen/Green Ammonia plant would require to be included through
amendment in the existing EC.

Industrial Shed mentioned in the Notification S.0. 3252 (E) dated 22/12/2014 implies buildings/ warehouses/ sheds (whether RCC or otherwise) which are used for housing machinery of industrial units and/ or storage of raw materials and finished goods and industrial products including but not limited to industrial and factory-made products, irrespective of the location and proximity of the Industrial Shed vis-a-vis any Industry. These Industrial Sheds shall strictly implement the guidelines issued vide OM dated 9/06/2015 to ensure sustainable environmental management. However, if any of the activities/ processes covered in the schedule to the EIA Notification 2006 are housed in the said Industrial Shed, then the same shall be required to obtain prior EC under the provisions of EIA Notification, 2006
if the size of the industrial shed is 2> 1,50,000 sq.mtrs of built up area it shall be required to obtain prior EC under item 8(b) of schedule to the EIA Notification 2006, irrespective of the type of industry/ utility it houses.
The existence of the interim Order issued by High Court of Kerala at Ernakulum [in writ petition W.P. (C) No. 3097 of 2016 (S)] dated 17/09/2020 and 23/11/2020 against the amendment to the EIA Notification, 2006 dated 22/12/2014, this clarification, within the territorial jurisdiction of High Court of Ker la, is subject to the outcome of the said court case.

Standardizing the validity of baseline data and public consultation reports for submission of proposal within the validity period of Terms of Reference (ToR) under the provisions of EIA Notification, 2006-reg.
|
Baseline data used for preparation of EIA/EMP reports may be collected at any stage of the EC process or even before the grant of ToR.
Public consultation shall be conducted after the grant of ToR. The Public consultation conducted after the expiry of ToR shall not be accepted by the Regulatory Authority.
The baseline data and Public Hearing shall not be more than three years old at the time of submission of application for consideration of EC.
At the time of application for EC, in case baseline data is older than three years, but less than five years old in the case of River valley and HEP Projects, or less than four years old in the case of other projects, the same shall be considered, subject to the condition that it is revalidated with one season fresh non-monsoon data collected after three years of the initial baseline data.
In case the proposal for EC along with EIA/EMP reports based on the ToRs prescribed is not submitted within the validity period of ToRs, and/or not complying with the above-mentioned criteria, the concerned Member Secretary shall not accept the proposal and process shall be initiated de novo by the PP.
This O.M. is issued in supersession of OM no. J-11013/41/2006-IA-II (I) (Part) dated 29th August 2017 and with the approval of the Competent Authority.

Proposals involving expansion of existing EC
At the time of issuance of expansion ToR, the MS of EAC/SEAC shall endorse a copy of the ToR to the concerned IRO of MoEF&CC. Based on the same, project proponent shall approach the concerned IRO of MoEF&CC to issue CCR. Such request shall be expeditiously considered and disposed of by the concerned IRO within a time frame of three months from the date of application of project proponent. In case, the CCR is not issued within three months, the project proponent shall approach concerned Regional Offices of Central Pollution Control Board (CPCB) or MS of respective State Pollution Control Boards (SPCB) or State Pollution Control Committees (SPCCs) for the same.
The CCR issued by the concerned Authority shall explicitly state the date of inspection, present status of the implementation of the project along with compliance status to each of the condition prescribed in the EC.
CCR issued by the concerned Authority shall be valid for a period of one year from the date of inspection of the project. The submission of CCR beyond older than one year from the date of inspection shall not be accepted by the concerned MS of EAC/SEAC for placing it before the EAC/SEAC for carrying out the appraisal process.
Monitoring report issued by concerned IROs in conformity to the above, if available, can also be submitted by the project proponent in place of CCR.
Self-certified six monthly Compliance Report for the latest EC shall be sufficient if the project proponent applies for expansion within a period of six months from the grant of previous EC. If such application is submitted beyond the period of six months from the grant of EC, CCR shall be required for the latest EC.
B. Proposals involving expansion of existing project running on the basis of Consent To Operate (CTO) from SPCBs/ SPCCs (without requirement of EC)
At the time of issuance of expansion ToR, the Member secretary of EAC/SEAC shall endorse a copy of the ToR to the concerned MS of SPCBs/SPCCs. Based on the same, project proponent shall request the concerned MS of SPCBs/PCCs to issue CCR on the compliance status to the prescribed CTO conditions. Such request shall be expeditiously considered and disposed of by the concerned SPCBs/SPCCs within a time frame of two months from the date of request of the project proponent. In case, the CCR on CTO conditions is not issued within two months, the project proponent shall approach concerned Regional Offices of CPCB for the same.
The CCR on CTO conditions shall explicitly state the date of inspection, present status of the implementation of the project along with compliance status to each of the condition prescribed in the CTO. Such CCRs shall be forwarded by the concerned Member Secretary of SPCBs/PCCs to the MoEF&CC/SEIAA.
CCR on CTO conditions issued by the concerned SPCBs/PCCs shall be valid for a period of one year from the date of inspection of the project. The submission of CCR older than one year from the date of inspection shall not be accepted by the concerned MS of EAC/SEAC for placing it before the EAC/SEAC for carrying out the appraisal process.

If such application is submitted beyond the period of one year from the grant/renewal of CTO, CCR shall be required for the latest CTO.

Phosphoric Acid and Sulphuric Acid are inorganic compounds, manufacturing of Phosphoric Acid and Sulphuric Acid is not covered under the extant provisions of the EIA Notification, 2006 as amended from time to time, and shall not require prior EC.
In case, the Phosphoric Acid plant and/or Sulphuric Acid plant which are set up within the existing premises of the project/activity for which prior EC has already been obtained, it shall be ensured that inclusion/expansion/modernization of the said plant shall not result in increase in the production level of the project beyond the sanctioned capacity stated in the prior EC.

Manufacturing of Polyurethane foam shall not require prior EC and shall continue to be regulated as per the consent mechanism under the Air and Water Acts. It is also clarified that any further utilization of Polyurethane foam as a raw material/further application shall not require prior EC under the provisions of ETA Notification, 2006. However, the manufacturing of chemicals to be used as raw materials for manufacturing of foam shall attract the provisions of ETA Notification 2006, as applicable.
