(2.)25/02/2022Dear Sir, ADS Response: We thank you for the opportunity provided to us to present our proposal for establishment of Chlor alkali manufacturing unit at Plot No.20, JN Pharma City, Parawada, Visakhapatnam District, Andhra Pradesh. The minutes of the SEAC meeting held on 28.09.2021 indicate that our proposal was deferred, and advised JN Pharma City (JNPC) to obtain inclusion of chloralkali sector in the environmental clearance (EC). In this regard we wish to submit the following for your kind consideration; 1. JNPC obtained the environmental clearance vide letter no. J.12011/1/2004-IA (CIE) dt. 10.03.2005 under EIA notification 27.01.1994. It may be noted that industrial estates were included as a sector mandating environmental clearance on July 7, 2004 vide S.O. 801 (E), MoEFCC. The said notification does not discriminate industrial sectors to be established in the estate and mandated EC for all industrial estates. Accordingly JNPC obtained EC for the industrial estate project mentioning chemicals, bulk drugs and pharmaceuticals, and the same incorporates all chemicals both inorganic and organic chemicals. 2. The EIA notification 2006 exempts new EC for all the old industrial estates notified before 2006, accordingly JNPC obtained EC before EIA 2006 notification. EIA notification 2006 explicitly mentioned that industrial estates can be sectorial and or multi product, while the EIA notification 1994 did not make such distinction. 3. When similar issue were raised in the case of M/s. Sree Venkateswara Bio Management Systems (Proposal no. SIAAP/MIS/6/2019) project, the honorable State Expert Appraisal Committee (SEAC) and State Level Environmental Impact Assessment Authority (SEIAA) accepted the clarifications submitted by the proponent and issued the EC.
