During deliberations, EAC discussed following issues:

 

 

(i).        PP was asked to submit oil spill contingency plan for any potential leakage commensurate to the risk of the spill. PP also to submit its capability to respond the spill with trained manpower and equipment which they have. In case they don’t have the mandatory tier 1 capability then to produce commitment/MoU with service provider.

(ii).        From the raw data of ambient air quality data provided it appears that only a single 24 hourly sample has been collected for PM10, PM2.5, SO2, HC, NH3 and Benzene, while 08 hourly sample has been collected CO and O3, which requires further clarification from PP, to ensure reliable data has been generated, since the issue of impacts due to air emissions have been raised during PH.

(iii).        PP informed that total SO2 emission from the proposed project will be 2.4 kg/h. EAC suggested to provide basis of estimate of 2.4 Kg/h SO2 emission from the proposed project. Also Sulphur balance to be provided.

 

The above information has not been provided/circulated by PP to the Expert members of the Committee. 

 

Accordingly, proposal was deferred for want of above additional information. Above all additional information shall be submitted online to the PARIVESH portal for further consideration by EAC.

During deliberation, the Committee noted the following:

 

Bharat Petroleum Corporation Limited (BPCL) has proposed a Polymer Grade Propylene plant at Rasayani, approx. 50 km from Mumbai Refinery.  MoEFCC issued standard Terms of Reference (TOR) for carrying out EIA study vide letter no. No. IA-J-11011/168/2018-IA-II(I) dated 17th June, 2018.  Public Hearing was conducted on 24.09.2019 at Rasarang Building, HOC Colony, Taluka Khalapur, Dist. Raigad – 410207.

 

Stage -1 Forest Clearance was obtained from MoEF&CC, Nagpur vide F.No. FC-II/MH-163/2021- NGP/10134 dated 10.08.2022 for 22.9648 ha. However, earlier as per EIA /EMP report, “the total Forest Area to be diverted for laying the pipelines is 25.68 Hectares (Mangrove area: 21.9 ha and Reserved / Protected Forest area: 3.78 ha).

 

Further, PP explained that the total forest land requirement for the proposal is 22.9648 ha only. The requirement of optimum forest land for the diversion arrived after a joint site inspection with forest officials (undertaken by DCF, Alibag, Raigad) and scrutiny of the proposal. Therefore, Stage -1 Forest Clearance was obtained for lesser area i.e. 22.9648 Hectares.

 

PP has confirmed that there is no change in project configuration. However, the Committee suggested them to submit the same in writing.

 

The Committee noted that the ambient air quality monitoring was carried out at 8 locations during December 2018 to February 2019, which more than three years old data. The Committee also noted that the wind rose data shows predominant wind direction is from SE direction. But PP has taken wrong sampling stations i.e. most of stations are located at upwind direction instead of downwind direction.  Only one location was shown in downwind direction, which cannot represent correct ambient quality of the area as well as predictions. Considering sampling locations identified earlier was not appropriate and data is more than 3 years old now, the Committee suggested to carry out fresh ambient air quality monitoring for 3 months as per OM dated 8th June, 2022.

 

1.   It was also suggested that AAQ data (except monsoon) at 8 locations for PM10, PM2.5, SO2, NOX, CO and other parameters i.e. HC, Ozone, BTX and Ammonia shall be collected. The monitoring stations shall be based CPCB guidelines and take into account the pre-dominant wind direction, population zone and sensitive receptors including reserved forests.

2.   PP shall also confirm that Pipeline is not passing through ESZ of Thane Creek Flamingo Sanctuary. PP shall provide Map indicating distance of project from the nearest boundary of ESZ authenticated by PCCF/Wildlife warden.

Accordingly, proposal was deferred for want of above additional information. Above all additional information shall be submitted online to the PARIVESH portal for further consideration by EAC.

8.NAThis has reference to your Proposal No: IA/MH/IND2/74952/2018 (File No: IA-J-11011/168/2018-IA-II(I)) for environmental and CRZ clearance to the project of Installation of Polypropylene unit of capacity 450 KTPA at Rasayani, Khalapur Taluka, Raigad District, Maharashtra and interconnecting pipelines from BPCL Mumbai Refinery to Rasayani by M/s Bharat Petroleum Corporation Limited. The proposal considered for grant of environmental & CRZ clearance by the EAC (Industry-2) in its meeting held during 30-31 December, 2019 & 1st January, 2020 and 21-23 January, 2020 subject to the condition as under: ‘Stage-1 forest clearance shall be submitted for the forest area/mangrove area involved under the project as per the provisions of the Forest (Conservation) Act, 1980. No installation of pipeline/associated facilities shall be carried out in forest areas without prior permission from the concerned regulatory authority’. In this regard, it is requested to submit the Stage-I FC for taking further action into the matter. 24 Feb 2020

10.NAThe Committee, after detailed deliberations, desired for requisite information/inputs in respect of the following: (i) Details of protected area/ESA/ESZ within 10 km of the project area/pipeline route. Details of NBWL clearance and its updated status. Minutes of 14th meeting of the EAC (Industry-2 Sector) held during November 20-22, 2019 Page 151 of 168 (ii) Details of pipeline route passing through mangrove area, details of area to be diverted and conservation plan. (iii) Details of raw material/product taken through pipeline with quantity. (iv) Action plan vis-à-vis CRZ recommendations/conditions from the SCZMA needs to be submitetd. (v) The Committee noted that the project involve forest land. However PP is unable to explain to provide the details of status of forest clearance and accordingly PP needs to be submitted the details of FC proposal and its status. (vi) Details of rivers in the vicinity of the project site and details of mitigation measures to avoid pollution of rivers. (vii) Details of map as per requirements under CRZ Notification needs to be submitted. (viii) Onsite emergency plan as per MSIHC Rules. (ix) Plan for Corporate Environmental Responsibility with activities and timelines. (x) The Committee noted that there are Schedule I species in the study area. PP needs to prepare the species specific conservation plan along with budgetary allocation and PP to take approval for the Wildlife conservation and management plan from CWLW State Government. (xi) Issues raised during public hearing, response by the project proponent, action plan with budgetary allocation needs to be submitted. All Annexures of Public hearing proceedings needs to be submitted. (xii) The Committee also noted that the project involves CRZ issues and accordingly the comments from CRZ sector also needs to be obtained by the Sector before placing the project in the EAC.
