Sub:  Upper Narmada Irrigation Project in Dindori & Anuppur Districts in Madhya Pradesh by M/s. Narmada Valley Development Authority-- Environmental Clearance – regarding

 

Sir,

This has reference to your letter No. NVDA/E&F/Env. Cell/09/733 dated 21.5.2009, 3.6.2009, 7.8.2009 and 19.8.2009 on the above mentioned subject.

 

2.   The project is located in Dindori District of Madhya Pradesh. The project envisages construction of 30.64 m high and 2120 m long composite (concrete + earthen) dam across river Narmada near village Rinatola in Dindori District, Madhya Pradesh. The main objective is to provide irrigation facility to 21,276 ha. (3879 ha in Rajendragram tehsil, Anuppur District and 17397 ha in Dindori tehsil, Dindori District). The total catchment area is 1174.83 sq. km. The total land requirement is 2952.15 ha. Out of which 2437.70 ha. is Private land & 514.45 Government land. No forest land is involved. 27 villages (4 - fully + 23 partially) consisting of 1382 families are likely to be affected due to this project. The Total project cost is about Rs. 569.59 Crores and will be completed in 6 years.

 

3.   The above proposal was considered by the Expert Appraisal Committee for River Valley & Hydroelectric projects in its meetings held on 16.6.2009 and 19.8.2009.

 

4.   The Ministry of Environment and Forests hereby accords environmental clearance as per the provisions of Environmental Impact Assessment Notification 2006, subject to strict compliance of the terms and conditions as follows:

 

Part A: Specific Conditions

(ii)               The land holding of project affected persons whose land is being acquired to be submitted to this Ministry. The R&R Package approved by the Ministry of Tribal Affairs, Government of India vide letter no. F.No.20011/13/2003-CP&R (NGO) dated 28.2.2007 should be followed for project affected persons. Adequate publicity of the compensation package should be circulated in the affected villages.

 

(iii)             The rehabilitation and resettlement of project affected persons should be completed within 36 months, as proposed in the R&R action plan. The zero month will start after getting all the clearances from central Government.

 

 

(iv)              The commitment made during the public hearing should be fulfilled.

 

(iv)       On farm development (OFD) works like land shaping land leveling, drainage facilities, field irrigation channels and farm roads etc will be taken-up in phased manner 2 years in advance of the start of irrigation from canal system in the entire command area. The Command Area Development Plan proposed in EIA/EMP document no. WAP/Envt/NVDA Projects/08 dated 17.7.2008 (page 2.1 – 2.23) should be strictly implemented.

 

(v)                 Conjunctive use of surface water has to be planned in the project to check water logging as well as to increase productivity.

 

(vi)               Water user association/ Co-operative and involvement of the whole community for disciplined use of available waters should be formed.

 

(vii)             As the dam height is about 30 m, a fish ladder should be provided for migration of fishes.

 

(viii)           The proposed Fisheries Development Plan in the reservoir with a stocking of 300 fingerlings per hectare should be implemented. The proposed budget of Rs. 2.5821 Crores allocated for this purpose should not be diverted.

 

(ix)               Occurrence of stagnant pools/slow moving water channels during construction and operation of the project providing breeding source for vector mosquitoes and other parasites. The river should be properly channelised so that no small pools and poodles are allowed to be formed. Even after taking precaution, due to unforeseen situations, breeding of mosquito and resultant malaria or mosquito borne diseases can increase. If such a situation arises, It will be the responsibility of project authorities to take all steps i.e. residual insecticidal spray in all the project area and surrounding 3 km. area keeping the flight range of mosquitoes in consideration.

 

(x)                 The proposed canal bank plantation programme of 6000 seedlings per kilometer on for 152 km on the both sides of the canal should be strictly implemented.

 

(xi)               The proposal for development of independent environmental laboratory for chemical analysis and Environmental Management Cell (EMC) at the project office should strictly taken-up

 

(xii)             Any other clearance from any other organization if required should be obtained.

 

Part-B: General Conditions

 

(i)                 Adequate free fuel arrangement should be made for the labour force engaged in the construction work at project cost so that indiscriminate felling of trees is prevented.

 

(ii)               Fuel depot may be opened at the site to provide the fuel (kerosene/wood/LPG). Medical facilities as well as recreational facilities should also be provided to the labourers.

 

(iii)             All the labourers to be engaged for construction works should be thoroughly examined by health personnel and adequately treated before issuing them work permit.

 

(iv)              Adequate financial provision should be made in the total budget of the project for implementation of the above suggested safeguard measures.

 

5.         Officials from Regional Office MOEF, Bhopal who would be monitoring the implementation of environmental safeguards should be given full cooperation, facilities and documents /data by the project proponents during their inspection.

 

6.    The responsibility of implementation of environmental safeguards rests fully with the NVDA and Government of Madhya Pradesh.

7.     In case of change in the scope of the project, project would require a fresh appraisal.

8.   The Ministry reserves the right to add additional safeguard measures subsequently, if found necessary and to take action including revoking of the clearance under the provisions of the Environment (Protection) Act, 1986, to ensure effective implementation of the suggested safeguard measures in a time- bound and satisfactory manner.        

9.    This clearance letter is valid for a period of ten years from the date of issue of this letter.

10.  The total amount of Rs. 7.74 Crores kept in the budgetary provisions for implementation of environmental management plan should be strictly adhered and not to be diverted for any other purpose.

11.   A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zilla Parishad/ Municipal Corporation, Urban local body and the local NGO, if any, from whom suggestions/ representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the Company by the proponent.

12.  The proponent should advertise at least in two local newspapers widely circulated in the region around the project, one of which shall be in the vernacular language of the locality concerned informing that the project has been accorded environmental clearance and copies of clearance letter are available with the State Pollution Control Board/Committee and may also be seen at Website of the Ministry of Environment and Forests at http://www.envfor.nic.in

 

13. The project proponent shall also submit six monthly reports on the status of compliance of the stipulated EC conditions including results of monitored data (both in hard copies as well as by e-mail) to the respective Regional office of MoEF, the respective Office of CPCB and the SPCB.

14.   Any appeal against this environmental clearance shall lie with the National Environment Appellate Authority, if preferred within a period of 30 days as prescribed under Section 11 of the National Environment Appellate Authority Act, 1997.
